S.A. ConCourt Rejects Lungu Family’s Appeal

The Constitutional Court of South Africa has denied an application by the family of former President Edgar Lungu to appeal directly before it against a ruling by the Pretoria High Court, which ordered the repatriation of Mr. Lungu’s body to Zambia.

In its decision, the Constitutional Court found that no sufficient grounds had been presented for a direct appeal and, as a result, leave to appeal was refused.

The ruling, issued by a full bench of the Constitutional Court led by Chief Justice Mandisa Maya, upholds the earlier decision of the Pretoria High Court, which had directed the repatriation of Mr. Lungu’s body to Zambia for a state funeral.

The ruling was officially communicated by Acting Registrar Dunisani Mathiba to all legal representatives involved in the case.

The matter arose when the Government filed a suit against the Lungu family, seeking a court declaration granting the state authority to return the late President’s body to Zambia for a state funeral.

Plans for Mr. Lungu’s burial, initially set for June 2025, were delayed after both parties mutually agreed to await the court’s ruling.

  1. This Lungu family is a let down and not ashamed of themselves for doing this honestly speaking who does that what are they trying to archive for doing all this drama, but when all is done whether they like it or not the man will be put to rest in Zambia.

  2. Come back home guys. Swallow your pride. Let your loved one be laid to rest in his homeland in dignity, not lying in a morgue for all eternity and for what exactly? Because you have grievences with the sitting Head of state? C'mon. Stop using your loved one as a porn for political clout and as a deterent from facing the music which you know still looms when you return. Stop hiding behind a casket like cowards. And by the way, your lawyers are simply milking you for all its worth, encouraging you to drag this out, to fight a losing battle in the courts purely for their own financial gain. Can you not see that? Let common sense now prevail, pride and egos be put aside for the sake of your loved one who has been lying in a morgue for almost 3 months now!! Your reasoning no longer makes sense to the masses and the sympathy that might have been shared in the beginning is now wearing thin. Shame on you!
