Wrong understanding of the law. Malema was never found “guilty” of hate speech. He was found liable and can never be jailed under the current liability decision. The entire 119 paragraphs judgment does not mention the word “guilty”. The reason is because the Equality Court does not apply the “guilty test” in its proceedings. It uses the l liability test based on probabilities. It also does not use the “Sentencing” term. These terms (sentencing, guilty and accused) are reserved for criminal proceedings in a criminal court. Hate speech falls under civil matters where the penalty is an Order of court to pay something to the complainant. You dont find the respondent “guilty” for a complaint. You find the respondent “liable”. Therefore, Malema is not “guilty” of hate speech. Leave our brother alone. He is fighting the cancer of racism, not whites. If you touch him you touch us. We have no problem with white people. But the smell of racism will be confronted swiftly wherever it re-surfaces.
As I explained earlier. Malema is not “guilty”. I studied law in South Africa and I understand the judicial proceedings there better. The process is the same as in my country Namibia. Once again, leave Malema alone.
