Judgment in Malema firearm discharge case

The East London Magistrate’s Court in the Eastern Cape delivers judgment in the case against EFF leader Julius Malema and his former bodyguard Adriaan Snyman.

Malema is facing charges of discharging a firearm in public during the EFF’s 5th anniversary celebrations at Sisa Dukashe Stadium in Mdantsane in 2018.

On the other hand, Snyman is accused of unlawful possession of a firearm and ammunition.

Malema and Snyman applied for the charges against them to be dropped, citing a lack of evidence, but the application was dismissed.

Malema maintained that the case is a political ploy to tarnish his image.

  1. You can't silence the voice of the voiceless, the mouthpiece of the speechless, and the revolutionist in our time. The fighter of the marginalized and poor blacks. Viva cic viva the hope of the hopeless in our society 🎉🎉🎉

  2. Key Outcomes:
Guilty on Count 3: Both Malema and Snyman were found guilty of discharging a firearm in a public space without a valid reason. Magistrate Twanet Olivier ruled that the evidence, including video footage and ballistic analysis, proved beyond reasonable doubt that a real firearm was used, rejecting the defense's claim that it was a toy gun incapable of firing live rounds.
Not Guilty on Other Counts: They were acquitted on the charges of unlawful possession of the firearm and ammunition, as the court found insufficient evidence to support those specific violations.
Sentencing Pending: Sentencing arguments were not completed on September 29 due to the magistrate's need to review extensive evidence (over six hours of testimony review). The case was postponed to September 30, 2025, at 9:00 AM for the full delivery of the judgment and sentencing. Bail was extended in the interim. If convicted on the discharge charge carries potential penalties of up to 15 years in prison, though non-custodial options like fines are likely being considered.

  6. Any norinco rifle could have fired the same cartridge and the only match that was gonna be too convincing which is the bridge block didn't match which is a direct unique identifier. This means any norinco rifle could have fired the cartridge be it after the rally or before. The judge is grasping at straws here😅
