Masemola is in no way in the category of the Minister. It's just that he's steady but sure and diplomatic.

In determining national policing policy the Minister must do so IN consultation with MECs responsive for policing in the Provinces, section 206 of the Constitution. Did the Minister consult his KZN and/or Gauteng counter-parts in disbanding the PKTT? We doubt, and therefore the Minister violated the Constitution TWICE, in determining national policy AND in his direction.

This was difficult for General Masemola because he knows he wasn't brave enough to take Mchunu and Sibiya toe for toe but at the same time he knew Mkhwanazi was brave enough so he made sure not to anger Mchunu and Sibiya while at the same time making sure he buys enough time for Mkhwanazi and his team to push their investigations and find names.

This is what Masemola actually did and what was supposed to be his response:

When the issue of disbanding the Task Team arose, I entertained the idea in principle but proposed a structured approach that would not compromise ongoing cases if the directive were to be executed. In doing so, I prepared a report that gave the impression of compliance, but in reality, the team continues to operate.
This approach allowed me to appear cooperative while still safeguarding the operational needs of the Task Team. I deliberately avoided escalating the matter into a direct insubordination case that could waste valuable time and resources. A direct refusal—though justifiable—would likely have resulted in disciplinary processes aimed at determining who was “right” between myself and the Minister. Instead, my approach created a balanced middle ground.
At the end of the day, I did not comply with the Minister’s request, as it was unlawful and strayed into my operational functions, which fall solely under my authority. While I managed the situation with tact and without open confrontation, my actions ensured that the operational independence of my office was preserved.
When the question was first post to him, he actually kept on saying it will depend, until the Commissioner breathed down his neck and the english was too much and he said yes, he will not comply.

Clearly, General Masemola was not clear about what course of action to take. The winding down is implemented as a job preserving method. There was now an appreciation that something bigger was amiss, but it wasn't clear what exactly it was. Was there an attempt to remove him? So, what we can say is that there was a mistake there on his part, which demonstrates how complicated the space where political power affects or intersects with public service work is. What Madlanga might not appreciate is that he as a judge can defy an unlawful instruction because no one can remove him unless he is impeached, which requires substantial charges against him. What this demonstrates is the complicated mess under which Directors-General operate in, where they are easily at the mercy of political heads. The question at 5:30:52 is quite critical because it's clear we need to build safeguards into the system that are beyond the President. The Portfolio Committee as an oversight body failed here.
