The government’s new proposal introduces a “Transformation Fund,” allowing companies to earn points by contributing capital to Black-owned enterprises rather than strictly altering their own internal management or ownership structures. While the ruling African National Congress maintains the laws are vital—citing data that white citizens still hold 61% of top management posts despite being only 7% of the population—critics, including Elon Musk and the Democratic Alliance, argue the policy hampers investment.
