South Africa has proposed significant amendments to its Broad-Based Black Economic Empowerment (B-BBEE) policy, a move widely seen as a response to growing diplomatic and economic pressure from the US. Originally designed to redress apartheid-era inequalities, the policy has drawn the ire of US President Donald Trump, who has imposed tariffs on Pretoria and criticised the laws as discriminatory. The government’s new proposal introduces a “Transformation Fund,” allowing companies to earn points by contributing capital to Black-owned enterprises rather than strictly altering their own internal management or ownership structures. While the ruling African National Congress maintains the laws are vital—citing data that white citizens still hold 61% of top management posts despite being only 7% of the population—critics, including Elon Musk and the Democratic Alliance, argue the policy hampers investment.
